1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the FANR website, web application, and mobile applications (collectively, the "Platform"), operated by FANR ("FANR", "we", "us", or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. The FANR Platform
FANR provides a platform that connects property owners and real estate developers ("Clients") with independent, verified real estate service providers ("Providers") to facilitate project setup, provider matching, milestone tracking, contracts, and payment coordination. FANR is not a party to agreements formed between Clients and Providers and does not itself provide construction, design, or development services.
3. Eligibility and Accounts
- You must be at least 18 years old and capable of entering into binding contracts to use the Platform.
- You must provide accurate, current, and complete information during registration and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and OTP codes, and for all activity under your account.
- Providers may be required to complete a verification process, including submission of licenses, certifications, or company registration documents, before being listed on the Platform.
4. User Conduct
You agree not to:
- Provide false, misleading, or fraudulent information.
- Circumvent the Platform to avoid applicable fees or bypass verification, contracting, or payment processes.
- Use the Platform for any unlawful purpose or in violation of applicable Saudi laws and regulations.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Platform or its systems.
- Harass, abuse, or harm other users of the Platform.
5. Projects, Offers, and Contracts
Clients may submit project or service requests, and Providers may submit offers in response. Once a Client and Provider agree on terms, FANR may facilitate generation of a contract reflecting the agreed scope, pricing, and milestones. Clients and Providers are solely responsible for the accuracy of project details, the quality and legality of services rendered, and compliance with the terms of any contract entered into through the Platform.
6. Payments and Fees
FANR may charge service or commission fees for use of certain Platform features, as disclosed at the relevant time. Payments between Clients and Providers, where facilitated through the Platform, are subject to any additional payment terms presented at the time of transaction. You are responsible for any taxes applicable to amounts you receive or pay through the Platform.
7. Intellectual Property
The Platform, including its design, text, graphics, logos, and software, is owned by FANR or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent.
8. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. FANR does not guarantee the accuracy, quality, safety, or legality of services offered by Providers, or the reliability or conduct of any Client or Provider. FANR does not guarantee uninterrupted or error-free operation of the Platform.
9. Limitation of Liability
To the maximum extent permitted by applicable law, FANR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Platform or any transaction, contract, or dispute between Clients and Providers.
10. Suspension and Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our discretion. You may stop using the Platform and request account deletion at any time.
11. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia.
12. Changes to These Terms
We may modify these Terms from time to time. Material changes will be communicated through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
